Privacy Policy
USER AGREEMENT AND PRIVACY POLICY
The provider of the service of using the LMS Collaborator online platform takes great responsibility for maintaining the confidentiality of information and personal data received, and takes all measures necessary to ensure their secure storage.
This Privacy Policy governs the relationship between the Service Provider and the User on the use of confidential information and personal data, the procedures for obtaining, protecting, processing, transferring and deleting information, and is an integral part of the Service Agreement for the use of the LMS Collaborator online platform.
This Privacy Policy uses the following terms with the following meanings:
Personal data — information or a pool of information about an individual who is or can be specifically identified;
Confidential information — information or data that are defined as confidential and received by the Service Provider and the Customer from each other in the process of providing the services of using the LMS Collaborator online platform;
Data import — entering the data provided by the Customer into the LMS Collaborator online platform;
Cloud storage — protected cloud storage services, where data is stored on a large number of networked servers on the territory of the European Union;
Consent for the data transfer — clearly defined consent of the owner of the data or of the legal and authorized user of such data to their transfer, expressed, among other things, by accepting these conditions and ordering the use of the LMS Collaborator online platform.
General Data Protection Regulation — (GDPR, Regulation (EU) 2016/67), part of the European Union legislation concerning the protection of personal data of persons within the EU and the European Economic Area.
Service Provider follows ISO 9001 and General Data Protection Regulation standards when dealing with personal data and confidential information.
The relationship between the Service Provider and the Customer is subject to the laws of Ukraine and other countries, where it is mandatory.
Customers confirm their consent to comply with the terms of this Privacy Policy by accepting all its terms and ordering to use the LMS Collaborator online platform.
Acceptance of this Privacy Policy is mandatory for the right of access to use the service, and is considered a voluntary consent for the transfer and processing of personal data and confidential information in accordance with these conditions and the Service Agreement for the use of the LMS Collaborator online platform.
GUARANTEES
The Service Provider and the Customer are obliged to respect the confidentiality of all data received in connection with the provision of the service of using the LMS Collaborator online platform.
COMPLIANCE WITH GENERAL DATA PROTECTION REGULATION
The Service Provider is compliant with the GDPR, in particular:
- Does not use Personal data for purposes other than those described in this Privacy Policy and the Service Agreement for access to the LMS Collaborator online platform.
- Clearly identifies the Personal data received;
- Controls the availability of consent to receive and process personal data;
- Enables complete deletion of personal data;
- Depersonalizes data for its further use by the Service Provider;
- Guarantees compliance with GDPR regulations for all entities that have access to personal data;
- Does not obtain or process personal data on ethnic or national origin, philosophical, religious or political views, medical and other data with a special access and storage regime;
- Stores data on secure storage devices that comply with GDPR requirements.
SOURCES OF INFORMATION
The Service Provider receives information from the Customer at the moment of formation of the personal account of the user and in the process of using the LMS Collaborator online platform.
The Customer is responsible for the validity of the provided personal data, as well as for its timely updating. The Customers guarantee that they received and transmitted Personal Data lawfully and on the basis of sufficient consent and permission of the owner of such data.
The service provider has the right to demand confirmation of the validity of such data and the consent of the owner of personal data in the form of a written confirmation.
PURPOSE OF OBTAINING INFORMATION
The service provider may use personal data with the following purpose:
- Provision of services,
- Provision of technical assistance.
DATA IMPORT
After providing the LMS Collaborator online platform for use, the Customer may transfer data that is entered into the platform. The Service Provider guarantees the security of such data in accordance with this Privacy Policy and the Service Agreement for access to the LMS Collaborator online platform. Immediately upon receipt, the data entered by the user is transferred for storage to remote Cloud storage services and cannot be used by the Service Provider.
THIRD PARTIES
The Service Provider may provide confidential information and personal data to third parties on the direct request of the customer (for example, for the purpose of integrating the platform with other services). In such cases, the Service Provider is not responsible for the security of such data and cannot guarantee the special status of such information.
Service Provider may disclose Confidential Information and personal data to third parties only for the purpose of providing services to the Customer, containing cases of involvement of third parties specialists, connection of third party software. In this case, the Service Provider shall be responsible for the actions of such third parties as their own. The use of personal data shall be carried out only in accordance with the professional, official or employment duties of such persons. These third parties are obliged in any way to prevent the disclosure of personal data that has been entrusted to them or that has become known to them in connection with the performance of professional, official or employment duties. The Customer gives its consent to such transfer of information to third parties by accepting the terms of the Privacy Policy.
Information may also be disclosed to law enforcement and other governmental authorities, if such disclosure is mandatory and based on reasonable request, of which the Service Provider shall immediately notify the Customer.
WITHDRAWAL OF CONSENT TO THE TRANSFER AND PROCESSING OF INFORMATION
The Customer at any time has the right to withdraw their consent to the transfer and processing of personal data. In this case, the Service Provider is obliged to do all possible actions to delete/transfer the personal data to the Customer and to take all actions necessary for the uninterrupted provision of services to the Customer. At the same time, in this case, the Service Provider is not responsible for the quality and uninterrupted provision of services.
DATA PROTECTION
The Service Provider guarantees the protection of personal data and confidential information from accidental loss or damage, from illegal processing, including illegal deletion or access to personal data not provided by the terms of this policy.
The Service Provider uses only secure and protected resources to store confidential information and personal data, including Cloud storage services.
THE PROCEDURE OF CHANGING THIS POLICY
The Service Provider has the right to change the terms of this privacy policy, and the client will be notified at least one calendar month before the start of such changes
